Terms of Service

These Terms of Service (“Terms”) govern your use of the Label2Go website at label2go.com and the Label2Go application at app.label2go.com (together, the “Service”), provided by Ultra Power Site LLC, a Florida limited liability company (“we”, “us”). By using the Service you agree to these Terms. If you use the Service for a company, you confirm that you can accept these Terms for it, and “you” means that company.

1. The Service

Label2Go is software that helps businesses compare rates and create UPS and FedEx shipping labels with their own carrier accounts. Label2Go is not a carrier, a shipping broker or a reseller of postage. Postage and carrier charges are set and billed by the carriers directly to your carrier accounts.

2. Eligibility and accounts

• The Service is for businesses and people at least 18 years old.
• Access is by request. We review each request and may approve or decline it at our discretion.
• You are responsible for the accuracy of your account information, for keeping passwords and credentials safe, and for all activity under your account, including by users you add.

3. Your carrier accounts

• To create shipments you must connect your own UPS and/or FedEx account. You authorize us to use the credentials and access you provide to quote rates, validate addresses and create, track and void shipments on your behalf.
• You must comply with the terms of your carriers, including the FedEx End User License Agreement you accept in the App and the terms UPS presents when you authorize access to your UPS account, and you are responsible for all charges, surcharges and adjustments billed by them.
• Rates, delivery dates and surcharges shown in the Service come from the carriers or are estimates. The carrier’s invoice is final.
• We are not responsible for carrier services, including delays, loss, damage, refused claims, or changes to carrier rates, rules or availability.

4. Your responsibilities for shipments

You are responsible for the content of your shipments and for the information you enter, including addresses, weights, dimensions, declared values and service options, and for complying with shipping, export and other applicable laws and carrier rules on prohibited and restricted items.

5. Plans, trial and billing

• Plans and the number of labels each one includes per month are described on our pricing page.
• New accounts start with a 30-day trial of the Business plan, without a credit card. If you choose a paid plan during the trial, the first charge happens when the trial ends. If you do not, the account moves to the Free plan.
• Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically at the end of each period until you cancel.
• You can change plans, update your card, see invoices and cancel in the App under Settings → Billing → Manage billing. When you change plans, Stripe may charge the difference for the rest of the current period at the time of the change.
• A cancellation takes effect at the end of the period you already paid. Fees are not refundable, and we do not give refunds or credits for partial periods, except where the law requires it.
• Fees do not include taxes. If taxes apply, they will be added to your invoice.
• We may change plans or prices with at least 30 days’ notice. Changes apply from your next billing period.

6. Acceptable use

You will not: use the Service for illegal shipments or activities; access accounts or data that are not yours; interfere with or overload the Service; reverse engineer it except where the law allows; resell it without our written permission; or use the API beyond reasonable limits we may set.

7. Your data

You own the data you put into the Service. You give us permission to host, process and transmit it only to provide and improve the Service, as described in our Privacy Policy. You are responsible for having the right to share your recipients’ information with us.

8. Our property

The Service, including its software, design and content, belongs to Ultra Power Site LLC and its licensors. These Terms do not give you any right to our trademarks. UPS and FedEx names and marks belong to their owners.

9. Cancellation and termination

You may cancel your paid plan at any time as described in section 5, and ask us to close your account by writing to support@label2go.com. When we close your account, we delete your company’s data as described in our Privacy Policy. We may suspend or terminate access if you breach these Terms, if required by law or a carrier, or to protect the Service or other users.

10. Disclaimers

The Service is provided “as is” and “as available”. To the extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that carrier systems will be available.

11. Limitation of liability

To the extent allowed by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.

12. Indemnity

You will defend and indemnify Ultra Power Site LLC against claims arising from your shipments, your data, your use of the Service in breach of these Terms, or your violation of law or carrier terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new “Last updated” date and, for important changes, notify App users. Continuing to use the Service after the change means you accept the new Terms.
